Among the dozens of e-mail messages and minutes of meetings produced by prosecutors in court yesterday, one showed how church leaders tried to doctor documents relating to bonuses paid to Ms Ho Yeow Sun, pop singer and wife of Pastor Kong Hee.

According to a report in The StraitsTimes, in an email dated March 14, 2007, and addressed to founding member and deputy pastor Tan Ye Peng, former finance manager of production house Xtron Productions Serina Wee proposed that in order to avoid public scrutiny, sponsors should declare the money as personal gifts to Ms Ho.

Wee had written: "After Wahju (Hanafi) sponsored $479,750 to cover the bonuses and advances given to Sun, we are still short of $118,028 to cover the total amount given to her.

"... I have come up with a proposed list of persons to talk to, to get them to write a letter to Xtron to say that their giving is meant for Sun personally.

"We can explain to them that because of the public scrutiny, we don't want Xtron to be seen giving money to her beyond her salary."

In an email to Tan and Chew dated March 30, 2010, Wee, who is also Xtron's accountant, stressed the need to come up with explanations.

The email came after questions were posed by a church member.

That email was then sent to church founder, Kong Hee, who is also on trial.

In it, Wee raised concerns about how people would find out about a S$10 million bank loan Xtron took, even after the church had loaned the company S$21.5 million in bonds.

The loan from the church was meant for Xtron to buy a unit at RiverWalk.

Wee stressed in the email the need to sell off the RiverWalk unit as soon as possible, so they can "reduce the share capital of Xtron from S$6 million to S$6".

She said this was to ensure there won't be a query as to where the shareholders got the capital from.

In day 2 of the resumed City Harvest Church trials, focus was given to the company Xtron Productions and how much control the church had over the company.

In particular, Serina Wee, Xtron’s accountant since 2007 and senior member of CHC was scrutinized for her role in the company.

One director of Xtron, Mr Choong Kar Weng, took the stand to answer questions about the company.

Responding to the prosecution’s questions, Mr Choong shared that he was not too concerned with who Wee was working for when she had made the bond drawdown decisions on behalf of Xtron.

He indicated that he trusted her and believed she wouldn’t do anything to harm Xtron.

The prosecution brought forward evidence that at a church meeting in August 10 2008, executive members were told that $18.2million in bonds were issued by Xtron for the purchase of Riverwalk commercial building near Boat Quay.

Mr Choong denied having knowledge of this saying that it was strange as only $8.5million was issued.

Email evidence was also brought forward showing Ms Wee asking other senior church leaders whether Xtron could be described as being under CHC’s control.

The prosecution is attempting to prove that CHC had control over Xtron Productions in order to make their case against the 6 CHC leaders on the misappropriation of over $50 million.

The trial continues.

City Harvest Church senior pastor and pop singer Ho Yeow Sun reportedly received more than $500 000 in bonuses in 2006.

The huge takings were covered up by City Harvest Church by the alleged forging of documents to indicate that the money had been gifted to her from sponsors.

This includes the sums of $30 000 for a birthday cash gift and $80 000 for a ‘performance bonus’ for several hit songs.

Part 2 of the CHC trial is currently under way after being stopped for 3 months.

Yesterday marked the first day of the 2nd part of the trials where this information was revealed.

Prosecutors made a case that management company Xtron, who was the company behind Ms Ho’s music career was actually completely controlled by the church.

CHC leaders stand accused of using Xtron and another shell company Firna to pay Ms Ho from church funds. Then, using more funds to cover their tracks resulting in a total misappropriation of over $50 million.

The church leaders have seen huge support with many church followers lining up outside the courts since early morning in order to try and get a seat in the courtroom.

The 6 church leaders stood together in the dock but one, Chew Eng Han, reportedly kept a distance from the other 5. He was a church stalwart at the time but had quit the church in June.

Day 2 of the trial is underway today.

Overseas and local churches alike are upholding City Harvest Church and its leaders in prayer as the start of the second tranche of court hearing begins.

“We promise City Harvest and its leaders that we’ll continue to support you till the end, and we’re going to see the victory together, in the name of Jesus,” says Rev. Dr. Babu Dayanand, senior pastor of Landmark Church.Seen outside the Bethany Presbyterian Church in Upper Payer Lebar Road and Landmark Church in Little India are banners that declaring that these churches are praying for City Harvest Church and its leaders.

The leaders of CHC steps into court the second time last week as the second tranche of the trial commences. The prosecution alleges that CHC’s senior pastor Kong Hee, pastor Tan Ye Peng, Serina Wee, Sharon Tan, John Lam and Chew Eng Han have misappropriated more than S$50 million of church funds and have committed criminal breach of trust.

In this trying period, it has been heartening for members to see the support of other local churches.

Another organization praying for CHC is the LoveSingapore movement which has a network of 60,000 Christians. Besides having pastors pray for CHC from the pulpit, the committee also encourages church members to continue to pray for CHC and their senior pastor Kong Hee, who is involved in the court case, as often as possible. This network of churches in their daily Morning Prayer anchored by different churches daily, and also in the churches’ individual prayer meetings.

Lawrence Khong, Chairman of LoveSingapore shared that the motivation behind praying is love.

“Because we love God and because we love the Church,” he tells City News. “There is only one Church in this city–many congregation make up this one Church and CHC is one of the many. We are family and we are the Body of Christ. When one part (of the Body) hurts, every part hurts.

“This is a time of severe testing for the entire Body of Christ. We are all on trial before a righteous God who is all-loving, all-knowing, all-powerful. So, we would much rather talk more with our righteous God and less with others, especially on social media.”

Serina Wee and other City Harvest Church leaders told auditors one thing and their parishioners another, court told.

The prosecutor tried to prove this yesterday by producing a series of e-mail messages to show that three of the accused - Serina Wee, who was Xtron's accountant, Chew Eng Han and Tan Ye Peng - were in cahoots to hide details and deflect questions about the church's connection with Xtron, even from the church's own members.

One set in 2008 had to do with the church paying exorbitant rent for a Riverwalk property from the company. "I feel it's hard to justify to the members why CHC (City Harvest Church) needs to lose $480,000 a year from the arrangement," said Wee.

This amount was meant to help Xtron pay off a bank loan instalment which members did not know about, Wee said in her e-mail.

Wee, Chew and Tan were also worried about how to present the two entities' close connection to the church's auditors and members.

"If anyone asks about the profits made (by Xtron from the Riverwalk rental during the City Harvest Church board meeting), then we should address it and say that Xtron is under CHC control and therefore any profits will be well managed by us for future works," wrote Chew.

Tan then replied: "Are we allowed to say that Xtron is under CHC control?" To which Chew replied: "Not in such bold terms, but we should let our members have assurance that Xtron's gains will be channelled into projects in line with the CHC vision."

He added: "The only problem of using the word 'control' is that if it gets to the auditors, they may get ultra-conservative and say we own Xtron, and therefore we need to consolidate (the two). So we need to find a balance between what we tell our AGM - annual general meeting - (they want full control) and what we tell auditors (we don't want them to think we control Xtron)."

In another set of e-mail messages in 2008, Wee also told church founder Kong Hee, Tan and Chew that she had received advice from a fellow church member: "We can talk about Xtron to the members in the (extraordinary general meeting) but don't minute down everything. Just minute down necessary portions so as to not show too close a relationship or control over Xtron."

It was also reported yesterday that Serina Wee, former finance manager of production house Xtron Productions proposed that in order to avoid public scrutiny, sponsors should declare the money as personal gifts to Ms Ho.

Court also told that over $10 million was spent on Sun Ho's US album and she also allegedly received over $500k in bonuses and advances.

In defence, Kong's lawyer Edwin Tong produced emails between Kong and United States producer Justin Herz between 2006 and 2008, that showed discussions on Ms Ho's foray into the US pop music scene and profit and loss projections from her career. He was countering a point made earlier by the prosecution that the sales projection of Ms Ho's album was 200,000, which would yield S$2.17 million -- falling short of the S$13 million in bonds that Xtron Productions had to redeem.

Xtron managed Ms Ho from 2003 to 2008. The defence was cross-examining Xtron director Choong Kar Weng.

Mr Herz and another US-based marketer Lisa Ellis projected 2 million in album sales for Ms Ho and total net profit over seven years (from 2008) exceeding US$25 million. This would be from album sales, performances and other related revenue streams.

Ho Yeow Sun, the singer-wife of City Harvest Church (CHC) founder Kong Hee, was allegedly accorded a $10 million budget to produce and market an English album in the United States, according to a document submitted to the courts as evidence.

Miss Ho, who's also known as Sun Ho, was the face of the Crossover project, an initiative started in 2002 by CHC to reach out to non-Christians through music.

Chinese newspaper Shin Min Daily reported that the document showed that the original budget set aside for Miss Ho's English album, titled China Wine, was an initial US$6.7 million (S$8.7 million).

However, that was later increased to US$8 million (S$10 million) after a meeting between directors of Xtron Productions, which manages Ms Ho, off the back of a projection that they stood to make US$10 million by selling 1.5 million albums at US$7 each.

Out of the budget, US$1.67 million (S$2.13 million) was paid out to acclaimed music producer Wyclef Jean, who was an executive producer on China Wine and US$2 million (S$2.55 million) to guest producers and singers.

US$1.05 million (S$1.34 million) was also spent on producing some four music videos, and a further US$1.10 million on marketing the album among other expenses.

Ms Ho was also the focus of yesterday's trial when the courts were told that she had received more than $500,000 in bonuses and advances.

The high-profile trial involving Kong and five other, who are contesting a charge for allegedly misusing more than $50 million of church funds, resumed on Monday (Aug 26) after a three-month break.

The trial continues today.

City Harvest Church founder Kong Hee was alleged to have spent over US$530,000 (S$677,000) on his airfare, according to a document submitted to the courts as evidence in the trial against him and five others.

Contents on the document showed that Kong's airfare was billed as an 'increase in travelling expenses' out of a US$13million (S$16.62 million) bond that was also used to repay a US$2.06 million (S$2.63 million) loan, and for an "English album" for his wife, singer Ho Yeow Sun, which amounted up to US$7.39 (S$9.44 million).

The same document also contained the breakdown of a US$6 million budget to produce an English album for Ho, who's also known as Sun Ho, that was later increased to US$8 million after a meeting between directors of XTron Productions.

XTron Productions is the company which is managing Miss Ho.

Kong and the five others -- Serina Wee, John Lam Leng Hung, Tan Ye Peng, Sharon Tan Shao Yuen and Chew Eng Han -- are standing trial against a charge of misusing more than $50 million of church funds to fund Ms Ho's music career, and to cover up the usage of the initial expenditure.

Miss Ho was pencilled in as the face of the church's Crossover project, which was started in 2002 to reach out to non-Christians through music.

The supposed sham bonds at the heart of the City Harvest criminal trial took centre stage yesterday, as defence lawyers and the state tussled over their legitimacy.

Church members knew about them and approved of their purchase, said defence lawyers. A lawyer from Drew and Napier at the time who drafted one of the bond agreements did not raise any issues with the issuing firm’s director. The focus was on $13 million worth of bonds issued by music firm Xtron Productions which the church invested in 2007.

Accordint to a report from The Straits Times, The state charged City Harvest Church founder Kong Hee and five of his deputies last year for using $24 million of the church’s building fund to buy “sham bonds” in Xtron and another church-linked company, Firna, to fund the music career of Kong’s wife, Ms Ho Yeow Sun.

They later allegedly used another $26 million to cover up this first amount. In 2007, church executive members themselves had not objected to the use of the church’s building fund for investments in general. Yesterday, the defence noted that later, in 2010, after the Commercial Affairs Department had started investigations into these bonds, members voted to approve the specific bond transactions retroactively.

Earlier in the week, the lawyers had also noted that an auditing firm which vetted both Xtron and City Harvest also did not raise any concerns over the two entities’ transactions to Xtron director Choong Kar Weng. The state, however, rebutted these claims yesterday, saying that the auditors would have seen these bonds only after they were issued, when they opened the church’s and Xtron’s books at the end of the financial year.

And while defence lawyers showed on Wednesday that detailed profit and loss projections of Ms Ho’s American debut meant the church and Xtron, which was managing her, had put much thought into whether the project was financially viable, prosecutors disputed that. Deputy Public Prosecutor Christopher Ong pointed out yesterday that e-mails between Kong and American music producer Justin Herz detailing the projections were sent to Kong in 2008, a year after the church invested in the Xtron bonds.

That means they were irrelevant to the church’s decision to invest, suggested Mr Ong. This was supported by e-mails the prosecution produced earlier from Xtron accountant Serina Wee to church leader Chew Eng Han – two of the accused – written before the bonds were issued, saying that Ms Ho’s album sales would not be enough for Xtron to repay the church’s $13 million.

The state believes this showed the bonds were not legitimate as the church invested in them even as it knew the firm would have problems paying back the money. When questioned, Mr Choong said he had seen other cash-flow projections that indicated the firm could repay the church, but said they were not among the e-mails produced by the defence.
